There is the thought in the mental health community that anyone who feels they had no idea their ex-spouse or ex-girl/boy friend was unhappy, may not have been reading the signs. They may have been ignoring them hoping they would go away if no attention was paid to them. This is not typically the case. If a spouse or significant other is unhappy or dissatisfied in their marriage or relationship, they are more than likely exhibiting behaviors that reflect this dissatisfaction.

Some examples of these behaviors include:

being a workaholic and being disengaged from the family

main interest is being with the guys or gals and partying

living separate lives – different interests, different friends, different goals etc.

Rhode Island Divorce - "Post Divorce Do's And Dont's" -Family Law & Child Support by a RI Lawyer

(For your convenience, I have prepared this list of "Post Divorce Do's and Don'ts" which are applicable to Rhode Island divorces. Some may be applicable to your case and many will not be applicable. Please take a few minutes to read this. If you have any questions about this article or need any legal help please contact a Rhode Island divorce attorney)

Do's

Keep accurate records of child support, alimony, or other property settlement payment(s). In the event that there is a dispute as to whether or not you have made payments, accurate records are important for proof of payment.

If you have a property settlement agreement in your case, any changes to the property settlement agreement must be in writing and signed by both parties.

In the event that you do not have a property settlement agreement and there is only a final judgment in your case, changes can only be made by application to the court for a modification of the final judgment based on a substantial change of circumstances.

If visitation of your children is in dispute, keep accurate records of your visitations documenting dates, times, activities and/or confrontations with your ex-spouse.

If your ex-spouse is on "welfare" (afdc benefits) then do not make direct payments to her or him! You must make the payment to the State of Rhode Island. In the event that your ex-spouse is on welfare and you make payments directly to her/him, then these payments will be considered a gift. The State of Rhode Island (RI) will still pursue you for the child support payments, despite the fact that you have made the payments to your ex-spouse directly. This means that you will have to make double payments of child support.

Do not modify the property settlement agreement by an oral agreement. ALL changes to a property settlement agreement must be in writing, signed by both parties.

Do not make cash payments of alimony or child support without a signed receipt from your ex-spouse.

If you make payments directly to your child or buy anything for your child, these payments will be considered gifts to your child and will not be a credit towards child support. Therefore, if you want these types of payments to be considered child support, they must be given directly to your spouse as child support.

If there is a restraining order or no contact order in your case, do not contact your ex-spouse without the restraining order being dismissed. Even if your ex-spouse initiates the communication or invites you over, you could still be arrested for violating the restraining order. Any type of communication is a violation of the restraining order including e-mails, letters, faxes or voice mail messages. Do not rely on your ex-spouse's insistence that a restraining order has been dismissed. You need to verify with the Clerk of the Rhode Island Family Court that the restraining order has been dismissed.

Important Information

If your circumstances change, look into filing a motion to modify alimony, immediately. This only applies if the alimony is modifiable. If there is a property settlement agreement that is incorporated into the final judgment that states that alimony is non modifiable then the alimony is non modifiable. If there is no property settlement in your case and an award of alimony, then the alimony is probably modifiable upon a substantial change in circumstances. A substantial change of circumstances could be a loss of income, loss of a job or a disability etc.

A. Child Support

Child support does not automatically terminate when your child reaches eighteen (18) years of age. Child support will automatically accrue unless a Motion to Terminate Child Support is filed.

If you are the parent with physical placement of your child/children and your income significantly decreases or your ex-spouse's income significantly increases, then you should contact a lawyer to file a Motion to increase your child support payments.

If you are the parent without physical placement of your child and your income decreases significantly or your ex-spouse's income significantly increases, then you should contact a lawyer to file a Motion to lower your child support obligation. If you cannot pay your child support because of a change in circumstances you need to file a motion to modify child support immediately otherwise you can be subjected to a contempt proceeding for failure to pay child support.

I first learned this in my own divorce - where better to learn than firsthand?

I was caught in a huge attempt at concealing fraud, with my husband and his attorney in collusion to conceal it, then Kafkaesquelike, planning to blame it on me. They announced this at a settlement conference when asked by the pro tem judge, "Why are you going to trial, there is evidence of the fraud?"

With breathtaking nonchalance, opposing counsel prepared to assist my husband in implicating me in fraud.

At the time I thought I was the only one anything like this happened to. Over the years I have come to learn how common it is.

It took a lot of discovery to unearth the fraud including subpoeanas of clients. I won, but the cost was high. If opposing counsel not been so malignant in encouraging the fraud upon the court, it is possible we might have settled. But how would he earn his $350.00 an hour if we settle? Greed and ego play a big part in the cash cow known as family law. After losing at trial, he wanted an appeal, which they lost. Still on the warpath, opposing counsel wanted to go to the Supreme Court. However by now, my ex had spent enough on his losing battle and stopped the war.

Recently in Dallas there was a judge so incompetent she thought she had the right to eliminate evidence proving sexual abuse. She was exposed and did not get re-elected, but the trauma to the people in her court is severe and they suffer still.

In California, I recently read a transcript where the judge knowingly begins a trial at the wrong time and without both sides present. He ignores this and proceeds without the mother. This was a custody trial. Can you imagine the lack of judicial ethics to begin a trial at the wrong time? Due process? Gone. Constitutional rights? Ignored. This is family court.

In another case, a Silicon Valley attorney announces she is a 'prima donna' as if that excuses her abusive treatment of clients, and worse, the outrageous billing for doing nothing. She told one client: "Don't do discovery. Go ahead and lose and we'll get the money later." Really? I hope one of her clients files a bar complaint or sues for malpractice. She should be flipping burgers not bon mots.

Shocked, stunned and filled with rage at the lack of human compassion, at the malignancy that was this process, I felt trapped. But slowly, a change was washing over me. The more I learned about narcissism and evil, the more I gladly wore the badge they pinned on me labeled "target" . Rhode Island Divorce Strategy From Finding a RI Attorney to Filing for Divorce by a RI lawyer

The first step in obtaining a divorce from your spouse is finding a Rhode Island attorney who you are comfortable with. Many attorneys give free initial consultations while others charge for the first consult. I have always taken the position that the initial consultations will be free.

It is important to ask the proposed lawyer about his or her experience and qualifications to handle your case. It is also crucial to determine the hourly charge and the amount of any initial fee or retainer.

It is often impossible to determine how much a divorce will cost from beginning to end. However, it is a good idea to get an educated estimation of the eventual fee. This will never usually be more than a estimation because the cost of the divorce usually depends on several factors. Those factors could include how quickly a settlement is reached, the number of motions that each party will file, the amount / nature and complexity of assets to be equitably divided, the amount of documents involved in the case, the animosity of the parties to each other, the waiting time while you are in court and many other potential issues.

The Golden Rule is that the longer it takes to reach a settlement the more the divorce will cost because the lawyers will spend a lot more time working on the case. If there is no settlement and the case goes to trial or the day of trial, the divorce could get very expensive. If everything is agreed or nearly agreed to and the parties are relatively amicable then the divorce should take a lot less time and therefore be much less expensive.

Uncontested divorces in Rhode Island should be much less expensive then contested divorces. However, there are many different types of uncontested divorces. There are uncontested divorces with no real assets and uncontested divorces with assets to divide. If the divorce is uncontested and there are assets then the lawyer may need to prepare a property settlement agreement, deeds, qualified domestic relation orders etc. Therefore, the cost of an uncontested divorce could vary depending on the circumstances. For example if a lawyer has to draft a property settlement agreement , the lawyer will devote more time to the case.

I believe that a fair price for an uncontested divorce from soup to nuts in Rhode Island with no assets and no property settlement agreement is about $800 flat fee plus costs. The typical costs are a filing fee of $100 and service of process fees of approximately $40.

After you have retained the lawyer there is typically an intake process in which the lawyer gets the basic information so that he or she can properly represent you. The lawyer typically drafts the divorce documents and you sign them in front of him/her or another notary. These documents include a divorce complaint, DR(6) financial statement, statement of children of the marriage, counseling statement, report of divorce, summons and automatic divorce order etc. It is important that the DR6 form otherwise known as financial statement is accurately filled out.

There are many important decisions that may need to be made before you file for divorce in Rhode Island. Strategy is crucial in many instances!

In some cases, the attorney will file a motion for temporary orders when the divorce complaint is filed. A motion for temporary orders should be filed if the husband or wife is in need of temporary resolution of issues while the case is proceeding. These temporary motions typically request temporary child support, payment / contribution to daycare , contribution to medical bills, alimony, payment of household expenses, payment of the mortgage, taxes and insurance. A motion for temporary orders can also address child visitation and child custody issues related to the minor children as well as issues concerning exclusive use and possession of the marital home. The temporary motion can also request temporary orders concerning: restraining orders both financial and personal and a myriad of other temporary issues. The motion for temporary orders will typically be heard by the Court within 30-40 days of the filing of the complaint for divorce.

If no temporary orders enter then there is no legal obligation of a spouse to pay anything while the case is proceeding until there is a decision by the judge or the parties sign a property settlement Agreement. If there are no temporary orders, the financial issues, visitation and custody issues will be up to the parties to figure out while the case is proceeding without the benefit of a court order.

If there is an emergency in which irreparable harm will be caused if the party has to wait for a court date, then an emergency motion should be filed with the complaint. An emergency motion must either be verified under oath or be accompanied by an affidavit. The attorney will bring the emergency motion to the proper judge and ask for an ex parte order. Ex parte means that the other side is not present to object. The Rhode Island judge will only consider the affidavit and documentation before him. If the judge signs the emergency order than it will be served on your spouse by the constable along with the divorce complaint.

These types of emergency motion typically deal with issues concerning abuse of a child, dissipation or unreasonable spending of marital assets, domestic violence, child abuse or a plethora of other potential emergencies. If there is domestic violence involved in which you are in imminent fear of physical harm or have been abused or threatened with abuse please discuss with the attorney the benefits of filing a separate case called a Complaint Protection from Abuse! Please note that the Complaint Protection from Abuse is very different from an Emergency motion.

The timing of whether the divorce or Complaint Protection from Abuse case is filed first or whether they are filed simultaneously could be crucial to your case.

If an emergency motion is granted and emergency orders enter then a hearing will be set approximately 20 days to determine if the order should stay in effect while the divorce case is proceeding. At that hearing your spouse has an opportunity to contest the motion and tell his or her side of the story. At that hearing, the Court will determine whether the emergency relief will stay in effect while the divorce case proceeds.

Yet, the rules for expense deductions are clear: only one (1) parent, the legal guardian, can take deductions for the kids as "dependents" on the annual tax returns.

Okay, I admit it. I am the happiest divorced woman alive! And rightfully so. But this state of joy and bliss did not come to me right away. Oh, no, I worked for it and earned it, every minute of it. How did I get to this place of seventh-heaven, you ask? Let’s rewind the tape to the weeks leading up to the final court date. My initial reaction to divorce was like a form of death. I felt like a failure; and more importantly, there was this huge sense of loss, and my self-worth was at stake, which made this experience even more painful. My struggle for answers and for a sense of hope took me on a journey within. In the end, I found all I needed and a whole lot more.

Below are five suggestions I have for women who are struggling with divorce recovery or who are heading in that direction. What I suggest to you is what took me from a place of despair to a place of awesomeness.

(1) Learning to love yourself is first on the list. You are not a terrible person. Let’s settle that one first. So if you were thinking anything bad about yourself, you needn't go any further. And I have good news for you. When you really love yourself, really truly love yourself, you will no longer miss anything that is not good for you or that is not in your best interest. Do whatever you can to feel good about who you are. If you have problems getting started, here are two suggestions: first, always look your best, because if you look good, you will feel good. Second, grab yourself a blank notebook, and the next time you have your delicious cup of tea or coffee, make a list of everything that you are good at and everything you like about yourself. And most importantly, realize and accept the FACT that you are a wonderful human being, regardless of your marital status. And that's not because I say so but because... IT IS SO!

(2) Trust the universe. Trust the future. Trust that what you are going through is okay, and make peace with it. Trust that in time, you will see the value of this day.

(3) I cannot begin to tell you how therapeutic journaling is. Divorce is a time of discovery. You have all kinds of thoughts going through her head, and you need someplace to put them. Write about your thoughts, feelings, realizations, and ideas and you will learn, discover, and grow.

(4) Keep the lines of communications open with your friends and family, the people who really care about you, and don’t be afraid to share your grief. People care about you more than you know.

(5) And finally, here is the last tip, which is my favorite. Make this divorce better than okay. Make it magnificent. Make it awesome. Make it surreal. And how do you go about doing that, you ask? I’m so glad you asked, because I am dying to tell you. Start off by making a list of all the benefits of being where you are now in terms of your divorce. Then continue with everything you learned from your marriage and how you are changed in some way for the better. List all the ways you are going to be even more awesome than you were before. And for those of you who want to take it one step further, make this divorce one of the best things that could have ever happened to you. But how? There are different ways to go about it; I will share one way. Think of three different things that you could do over the next one to two years that would make you so proud. If you did this one thing, you would look at yourself in the mirror and say: "You rock!"

And when people say to you, "What happened? You always talked about starting your own business/ or writing a book/ or losing weight/ or going back to school/ or moving to Florida. So what happened this time?" You can look them proudly in the eye and say with a smile:--"It was that damn divorce. It brought out the best in me."

And then, my friend, you will be in touch with your true awesomeness.

Sort it now, rather than later – often the hassle of organising the division of property for a divorce settlement can seem too much like hard work. This is not best attitude to have or approach to take. By solving these problems and disputes now it will close that chapter and leave you free to continue with the rest of your life.

Remain positive – initially you may feel disappointed with the outcome of your divorce settlement; however it’s in your interest to keep a positive mental attitude. While you may feel that the shared property was divided unfairly during your divorce it’s important to remember that you are now free of the relationship and that your state of mind and well-being are far more important than any material possessions.

It’s worth remembering that it is the small things which can make the emotionally difficult process of divorce that little bit easier.

Some states, such as New York, are known as “equitable distribution” states. “Equitable” mean “fair” and assets will not be divided right down the middle based on their fair market value. Division of assets according to New York Divorce law states that all property obtained prior to the marriage still belongs to the individual and all property obtained afterwards will be distributed by the court based on established guidelines.

The factors a court considers in equitable distribution states for divorce assets are:

1. The difference in income and property from when the marriage began to the date divorce was filed.

2. The age of both individuals and how long they were married.

3. The needs of a parent who has won full custody of children involved (i.e. will they need the house to properly care for the child?).

4. Any loss of pension or inheritance.

5. What contributions the parties made to acquire the property.

6. Future earning potential of both parties.

7. Tax consequences.

Rhode Island Divorce - Women Can Hurt Their Own divorce!

As a Rhode Island lawyer I focus my practice on divorce and family law and I can tell you that I see this kind of thing all the time though I refuse to partake in it. Some women who feel scorned however will use any information they receive from friends, family, lawyers, etc... to exact any amount of pain and or retribution they can from their spouse regardless of the consequences to their actions to their spouse, to their spouse's family, to their children and sometimes even surprisingly to themselves.

Since I like using analogies and stories that I have seen in practice, a practical example here will help.

Pam's relationship with her husband Jerry has broken down. She isn't quite sure why although the tell-tale signs seem to be there. He is frequently working late. When he comes home there is little or no communication between he and his wife. Usually he doesn't stay home long but leaves to go do something or claims (at the age of 48 to be going out to play Dungeons & Dragons with his group of buddies). Yes, some true stories are odder than fiction. Jerry, however, seems to have some strange fetish for Pam's oldest daughter Casey who is 31 years old and lives the next town over because he is always going over to see her. Or. . . at least this is what Pam discovers later on.

Pam sees the marriage breaking down and she can't live like this anymore so she tells Jerry. Jerry immediately moves out, takes a few of his choicest possessions and goes to stay with his mom and dad for a bit. Pam suspects that something is going on but isn't sure what.

The police show up at Pam's doorstep not long after and ask if she has any knowledge about Jerry's activities. Pam is confused. The police officer's badge says "Narcotics Division". Pam is worried. After a few questions Pam learns they are looking into Jerry and his possible sales of heroine to minors. Pam is aware that her daughter Casey once had some issues with drugs in her early years.

Pam is very upset and speaks with Casey who tells her mother that she is addicted to heroine and that her husband Jerry is not only an addict but that he has been dealing heroine for more than a year.

Pam speaks with her Rhode Island divorce lawyer who indicates to her that since Jerry still has a good job then she has the opportunity to get alimony through her divorce but that her claim may now be at risk because of Jerry's activities.

Pam says that she wants all the assets because Jerry is dealing drugs even though she has no proof that Jerry is a dealer or is even addicted.

Pam asks her lawyer about what happens to alimony if Jerry goes to jail. Pam's divorce lawyer simply asks her a question.

Rhode Island Divorce Lawyer: Pam, Do you think he can pay you any alimony if he is in jail?

Pam: No.

Rhode Island Divorce Lawyer: Then do you think it's in your best interests to have Jerry put in jail when you are making a claim for alimony?

Pam: No.

Pam is very upset and now believes that the drugs are the reason for the divorce. She is furious and let's the narcotics officers search the house and gather any information they want on Jerry. Pam becomes an informant for them on Jerry's activities and wants to prove how bad Jerry is, make him regret he ever did this and have him pay for life.

Jerry is arrested and is caught red-handed with enough drugs to float a barge. Jerry is held without bail and the district attorney isn't offering any deals. There is virtually no doubt that Jerry will be going to prison for quite some time thanks to Pam's assistance.

Pam feels vindicated. Pam now wants all the assets and for him to pay alimony.

Jerry has lost his job and whatever money he has made has either been spent or disappeared.

Jerry has no ability to pay alimony in the eyes of the court, but after a conference with counsel and the family court judge it's the consensus that since the drugs did not affect the value of the existing assets that Jerry is still entitled to a portion of them even if Pam should receive a bit more because Jerry has been supporting her for more than 10 years.

Pam is outraged. Her attorney gets her about 80% of the assets in a settlement. Pam is upset because it just isn't enough in her eyes.

Pam dug a whole here. Her anger and her desire to get retribution for a horrible wrong that the wanted to put right caused Jerry to end up in jail sooner than he might have. Pam's cooperation and action with the law enforcement authorities could have been delayed until her divorce was completed or might have provided her with leverage against her husband to get 100% of the assets.

There are lots of pitfalls here and lots of things to consider. The point here is that Pam took action that was clearly detrimental to her divorce claims. Parties who go to trial rarely, if ever, get 100% of the assets of a marriage from a judge. The more realistic number is 60% if there is wrongdoing involved by one party.

Pam was not happy even though she should be. She got more in the divorce than the vast majority of all women who go through the Rhode Island Divorce process. The chances that Pam might have received more are very slim.

However, if there was any chance to get more than the 80% of the assets from the marital estate it was lost when Pam insured that Jerry went to jail before her divorce was completed. Pam lost site of her own financial best interests in order to feel vindicated.

This is not uncommon for this to occur with a man or a woman yet I see it more frequently with women who feel wronged in a marriage.

Rule of thumb would be to listen to you divorce lawyer. You can't expect to get the results you hope to achieve if you act against your own best interests and then expect your lawyer to repair the damage you've done and get you what you want in the end.

This is Not Your Parent's Divorce - 7 Ways Divorce is Different Today

1. More people are getting divorced. 50% of all first marriages end in divorce. 60% of second marriages end up in divorce. This is nothing like divorce of even 20 years ago.

2.The cost of divorce is escalating. In southern California some divorce attorneys charge $650 an hour or more. We are beginning to see a two tiered system: the upper middle classes and above hire a divorce attorney. Everyone else goes in pro per (represents themselves) due to lack of funds. Legal services are priced like any other service in a free market economy. Whatever the market will bear is the price we pay. With so many needing a divorce, an attorney can choose the well off and ignore the rest.

3. Lawyers can be picky. Even within the selected group that can afford an attorney, attorneys are so busy they can pick and choose their clients. Too many red flags and they will not take your case. A red flag can be female, lack of sufficient assets to litigate for a long time. Why is a woman a red flag? Lawyers don't want stories, and women like to tell the history of the marriage. Women often don't control the funds and it is easier to obtain a retainer from a male. Women are often more emotional and this puts them at a disadvantage.

4. More custody battles. The tender years doctrine is, alas, gone. Little babies are being taken from moms and given more visiting time to dad and sometimes sole custody. If mothers want their children, they often have to fight for them in a long and protracted battle.

5. Divorce has become a 60 billion plus industry. This includes what has come to be known as the "whores of the court." These are the evaluators, guadian at litems, therapists, career counselors and forensic accountants. The more you fight about, the more they pop up like mushrooms. You have a right to question, and say no to these people. If your attorney tells you otherwise, find someone who will tell you the truth.

6. A marriage is an economic unit controlled by the state. Marriages have become more complex as our financial lives have become more complex. Breaking up is not simple. It has all the elements of a corporation and must be treated as such. Breach of fiduciary duty used to be a concept most often talked about in the corporate world. Now, it relates as much to ending the economic unit called marriage.
